The Party Wall etc. Act 1996 is an area of property law which relates to shared walls or structures and building work close to boundaries or adjacent buildings.

The Act is often misunderstood or overlooked by developers and building owners when undertaking building work. This can lead to neighbourly disputes and complications during or after the project.

The legislation provides rights and procedures for both the developer and the adjoining owners or occupiers for works to party walls or at building boundaries.

When is the Party Wall Act applicable?

The Party Wall Act is applicable in three situations: altering or building a party (shared) structure, excavating within specified zones close to neighbouring buildings and building along a property boundary.

Do I need to service a Party Wall Notice?

You must inform your neighbour if you intend to:

  • Build on or at the boundary of your two properties
  • Excavate below or near the foundation level of neighbouring properties.
  • Work on a party wall or party structure.

The process of informing your neighbour requires the issue a specific written notice and has strict timescales for responding.

What is a Party Wall Award?

A Party Wall Award is a legal agreement between the building owner intending to undertake the work and the adjoining neighbour. The Award details how the party wall work will take place and when. It will also describe any protective measures to be taken during the works and liability for any damage.

The Party Wall Award is designed to be a fair and reasonable agreement, to avoid disputes between neighbours.

Who pays the Party Wall surveyors fees?

Usually the building owner undertaking the works pays for their surveyor fees and the adjoining owners fees, if the work is for the sole benefit of the building owner.
