Party Wall Adjoining Owner Surveyor

Provision of party wall surveyor services for the adjoining owner of a property, where the neighbour was undertaking works to the party wall between the buildings. The developer was undertaking the construction of a bespoke residential building within a very restricted, town centre location.

Challenges

  • The Party Wall Act provides strict and short timescales for property owners to respond to the notices, and unfortunately the adjoining owners had failed to respond within the prescribed period.
  • There was a likelihood that damage may occur to adjoining buildings during the construction works due to the restricted site access.

Solution

We were able to explain the implications of the Party Wall Notice to our client and that due to the expiration of the notice period, they were deemed to have dissented to the Notice.

Once appointed as Adjoining Owner Surveyor, were able to discuss the works with the Building Owners Surveyor and agree to the production of detailed works specifications and a schedule of condition to provide reliable evidence of any damage during construction.

The agreement of the Party Wall Award followed quickly, minimising delays to the construction project. The works were subsequently completed without issue for either party.
