Landlord Dilapidations Surveyor

The landlord required a Schedule of Dilapidations to be provided for a two story business park office in Newtown prior to the end of the lease. The tenants were vacating the property and relocating, but were not intending to complete any repairs prior to lease end.

Challenges

  • The scope of the dilapidations repairs and redecoration required by the tenant needed to be defined to establish the financial value to be negotiated.
  • The tenant had failed to maintain the heating boilers and the condition of the installation was unknown.

Solution

Preparation of a detailed schedule of dilapidations clearly established the scope of the claim and the various tenant breaches of the repair clauses in the lease. By serving the Schedule upon the tenant, the landlord followed the legal protocols associated with dilapidations claims.

In order to provide transparency of the cost of the dilapidation works, quotations were obtained from contractors which reflected market costs rather than surveyor estimates which can often be subjective. This assisted the negotiation process and a financial settlement was agreed quickly, enabling the landlord to be in funds to complete the works at lease end.

With our advice, the client undertook a service and inspection of the heating boilers and was able to confirm that the boilers were faulty and required replacement.
