Party Wall Adjoining Owner Surveyor
Provision of party wall surveyor services for the adjoining owner of a property, where the neighbour was undertaking works to the wall at the junction between the buildings. The developer was undertaking refurbishment works to a town centre shop and apartment building to extend the residential accommodation horizontally and vertically.
Challenges
- The developer followed the correct procedure and issued a formal Party Wall Notice, but with limited information relating to a proposed valley gutter.
- The Party Wall Act provides strict and short timescales for property owners to respond to the notices.
Solution
We were able to explain the implications of the Party Wall Notice to our client and the proposed works. The new valley gutter was potentially a source for future damp ingress and our client was not satisfied with the information provided, thus dissented to the Notice. Once appointed as Adjoining Owner Surveyor, were able to discuss the works with the Building
Owners Surveyor and agree to the production of more detailed works specifications and the agreement of a Party Wall Award. The works were subsequently completed without hindrance to either party.
